Reuters reports that the Supreme Court will let the lower court ruling stand and will not review a pay for delay deal between Bayer AG and Teva Pharmaceuticals for Cipro. That means the FTC, more than 30 States and various consumer groups eager to see an appeal won't get to see the Supreme Court hear the case, that was brought to the Court's attention by a number of National pharmacy chains and wholesalers.
The Supreme Court rejected taking the case without comment. In this case, pay for delay is OK the Justices tacitly say.
