Abbott scored big in a US court of appeals when it reversed a two-year old jury result awarding its rival J&J $1.67 billion for supposedly infringing Centocor's patents around Remicade. Abbott produces the rival drug Humira for treating rheumatoid arthritis patients.
The court however ruled that Centocor's patents were invalid as they hadn't reduced claims for a 'human variable region' to practice, saying "a mere wish or plan for obtaining the claimed invention was not sufficient". Oops!
