An update on this story from Derek Low and the In the Pipeline blog. many observers, including Derek, are very surprised that a settlement hasn't been reached long before now. The original challenge was filed more than 1 year ago.
It would appear the J&J feels it has a strong hand to play and is not very inclined to grant Merck concessions. 
It reminds me a bit of my friends the North-going and South-going Zax.
